Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor to their self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason, unless a statutory exclusion applies or the right of withdrawal has expired prematurely in accordance with statutory provisions. The withdrawal period is fourteen days. For contracts concerning the delivery of goods, the withdrawal period begins on the day on which you, or a third party named by you who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together; on which you, or a third party named by you who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately; on which you, or a third party named by you who is not the carrier, have taken possession of the last partial delivery or the last item, provided that the goods are delivered in several partial deliveries or pieces.

For contracts concerning services, in particular film development, scanning services, laboratory work, image editing or other photographic services, the withdrawal period begins on the day the contract is concluded. To exercise your right of withdrawal, you must inform us

by means of a clear statement of your decision to withdraw from this contract. This may be done, for example, by letter or email. You may use the model withdrawal form below, but this is not mandatory.

If you concluded the contract via our website, you may also declare your withdrawal using our electronic withdrawal function. You can find this on our website under “Withdraw from contract”. After submitting the electronic withdrawal, you will receive confirmation that your withdrawal has been received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you for the withdrawn contract, including delivery costs, without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

This does not apply to any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of such reimbursement. For contracts concerning the delivery of goods, we may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties and functioning.

Special Provisions for Services

If you requested that we begin providing the service during the withdrawal period, you must pay us a reasonable amount in the event of withdrawal. This amount corresponds to the proportion of the services already provided up to the time at which you inform us of your exercise of the right of withdrawal, compared with the full scope of services provided for in the contract.

The right of withdrawal for a service expires prematurely if we have fully performed the service and only began performing the service after you had expressly agreed that we may begin performing the service before the expiry of the withdrawal period, and you also confirmed your knowledge that you would lose your right of withdrawal upon full performance of the contract by us.

This applies in particular to fully performed services such as film development, scanning services, laboratory work, image editing or other photographic services.

Exclusion of the Right of Withdrawal for Custom-Made Goods

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.

This applies in particular to individually produced photo prints, enlargements, custom formats, laboratory prints, fine-art prints, contact sheets or other photographic products that are produced according to your specifications, from your negatives, from your files or according to your individual selection.

Note on Submitted Film Material and Negatives

A withdrawal does not release you from the obligation to pay for services that have already been properly performed, provided that the statutory requirements for this are met.

If you have provided us with films, negatives, slides, data carriers or other personal material for processing, we will return these to you upon request after withdrawal. You bear the direct costs of return shipment to the extent permitted by law.
